TERMS & CONDITIONS

1- Special Requests/Coverage The client understands and accepts that the photographic coverage will be as the Andy Chambers Photography professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instruction, although every effort is made to comply with the client’s wishes. Any special requests not notified on this booking form must be made by the client to the Andy Chambers Photography in writing.

2- The Photographer On occasions and without notice it may be necessary for Andy Chambers Photography to be substituted by another photographer, (e.g. due to ill health).

3- Exclusivity Andy Chambers Photography shall be the sole professional (still) photographer/s throughout the wedding day.

4- Images All image sizes are nominal. Andy Chambers Photography will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film/digital the exact colour as seen by the human eye.

5- Retouching Andy Chambers Photography will perform a standard amount of retouching to take the photographs to a quality of which he is proud. Further retouching, digital manipulation and artist finishing is available to the client as an optional extra.

6- Copyright Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of the photographer/s in writing.

7- Negatives/Digital Files Negatives/digital files remain the property of the Andy Chambers Photography. Your images will be held on file on external hard drives for 6 months.

8- Licence Andy Chambers Photography shall be granted complete artistic licence including in relation to the poses photographed and the locations used. Andy Chambers Photography judgement regarding the locations/poses and the number of images taken shall be final. Due to the vagaries of the weather, time and the willingness of subjects it may not be possible to capture all the images requested.

9- Coverage Andy Chambers Photography cannot be held responsible for the lack of coverage caused by the bride, bridegroom or other members of the wedding party not being ready on time, or willingness to be photographed, nor by restrictions placed on Andy Chambers Photography by other wedding suppliers, officials of the church, register office or licensed marriage venue.

10- Force Majeure or Act of God While every effort will be made Andy Chambers Photography to capture all events of the wedding, Andy Chambers Photography cannot be held responsible for situations out of his control such as acts of God, flood, fire, warfare, government laws or regulations, electrical failure, strikes by suppliers, and/or conditions beyond its control.

11- Display The client hereby allows the Andy Chambers Photography to display any images included in this contract in their studios, portfolios, literature, wedding, exhibitions and advertising. This includes the use of social media sites and websites. No use of the images will be made by Andy Chambers Photography for other commercial reason except with the written permission of the client. If the client wishes to withdraw consent for images to be used on social media or websites, this must be withdrawn in writing and received within 5 days of the images being issued to the client.

12- Time Allowed for Photographs There should be enough time allowed for Andy Chambers Photography to capture both group and romantic images. If there is not enough time allowed, Andy Chambers Photography cannot be held responsible for any missed images due to time limitations.

13- Delivery of Images Please allow up to 12 weeks for delivery of images after the date of the wedding. Every effort will be made to deliver images sooner, but due to peek times of the year this may not be possible.

14- Cancellation The client may cancel this contract at any time by giving written notice to Andy Chambers Photography, but in doing so shall forfeit any monies paid covering costs already incurred to date for meetings, admin & pre-shoots & reserving the date for you resulting in losses of other income. Should cancellation be received by Andy Chambers Photography less than 90 calendar days prior to the date of the ceremony, the client shall pay an additional amount so that the total paid by the client is equal to 50% of the contract value. Should cancellation be received by Andy Chambers Photography less than 60 calendar days prior to the date of the ceremony, the client shall pay an additional amount so that the total paid by the client is equal to 100% of the contract value. The said sum shall be payable as compensation as an estimate of the loss Andy Chambers Photography would suffer. Andy Chambers Photography may also cancel this contract if the deposit is not paid within two weeks of the signing.

15- Right of Withdrawal Andy Chambers Photography’s discovery of new information, changes to agreed circumstances, or other factors which tend to circumvent its policies may result in its withdrawal. Non-cooperation; changes in locations, facilities or available times; missed appointments and late payments are examples of contributing factors. Should Andy Chambers Photography initiate the withdrawal, all fees will be returned, excluding initial payment as well as fair market value for all services/products already provided. In case of withdrawal, £150.00 an hour is charged for all photography services already provided to the client(s). Should Andy Chambers Photography personal safety or safety of their equipment come under threat at any point during the wedding day, Andy Chambers Photography may cease their duties immediately and no refunds will be provided by Andy Chambers Photography to the client under these circumstances.

16- Limitation of Liability In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

17- Complaints Any complaints should be raised by the client with Andy Chambers Photography in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.

18- After Sales Contact This refers to the time period following the client’s receipt of images. All contact made should be via telephone, email or letter. Email or letter particularly in relation to sections 11, 14, 17 and 19 of this contract.

19- Albums All albums, if included in your package must be ordered no later than 6 months after you receive your wedding images. Failure to order your album within this time may result in forfeiting your album unless otherwise agreed in writing
